How embarassing that the acrimony in Congress has gotten us to this point. We’re now well into September and there still is no legislation. My view is that at this point to impose a tax retroactively is bordering on unconstitutional, even at the 3.5MM level. To retroactively apply a $1MM exemption is simply unscionable. What an embarassment.

Actually, the better way to look at it is the Steinbrenner’s have 600 million reasons to fight any retroactivity that comes down the pike which is why given it is almost August 1st and the first Estate Tax returns are due in the near future that retroactictity is a pipe dream.
